Proposal to apply Code Powers to Hyperoptic Ltd - Statutory notification under section 107(6) of the Communications Act 2003

Purpose of consultation

We are proposing to apply the electronic communications code set out in Schedule 2 to the Telecommunications Act 1984 as amended (the “Code”) on terms proposed in this consultation to Hyperoptic Ltd, whose registered company number is 07222543 (the “Applicant”). Further background about the Code (including the procedure that applies in this context) is set out in Section 2 of this document.

The reasons for our proposal are set out in Section 3 of this document and our draft direction applying the Code to the Applicant is set out in Annex 4 to this document.

The closing date for responses is 31 March 2014 and stakeholders wishing to respond to this consultation are directed to Annex 1 for information on how to do so.
