On 16 June 2006 Ofcom published a document, entitled ‘Updating Wireless Telegraphy Licensing Procedures and Criteria’ which contained two statutory notices (“the Statutory Notices”). The Statutory Notices detailed Ofcom’s intention to make: regulations in relation to the procedures for granting Wireless Telegraphy Act licences; and an order amending the Wireless Telegraphy (Limitation of Number of Licences) Order 2003 (“the 2003 Order”).
Ofcom has carefully considered the six responses to the Statutory Notices and as a result, has made some changes to the drafting of both statutory instruments. These changes do not reflect substantive changes in policy, but are aimed at ensuring greater clarity and improved accuracy in the final version of both instruments. The changes are discussed in this Statement.
