Crown Recognised Spectrum Access in 3400 to 3600 MHz

1.1 This statement confirms that, following our December 2010 statutory consultation , Ofcom has made regulations and an order to introduce tradable recognised spectrum access (RSA) for Crown bodies in the 3400 3600 MHz band. The following regulations and order were made on 17 February 2011, substantially in the form of the drafts on which we consulted, and will take effect on 14 March:

  1. The Wireless Telegraphy (Recognised Spectrum Access) (Amendment) Regulations 2011, (Statutory Instrument 2011/438).
  2. The Wireless Telegraphy (Recognised Spectrum Access and Licence) (Spectrum Trading) (Amendment) Regulations 2011, (Statutory Instrument 2011/440).
  3. The Wireless Telegraphy (Limitation of Number of Grants of Crown Recognised Spectrum Access) Order 2011, (Statutory Instrument 2011/441).
  4. The Wireless Telegraphy (Register) (Amendment) Regulations 2011, (Statutory Instrument 2011/439).

1.2 This statement also addresses the representations made during the consultation period. We received 5 responses. None of the respondents argued against our proposal to make the RSA regulations, but some raised issues about other elements of our policy in this band.
