Whereas:
A. On 9 April 2009, Ofcom gave Code powers to Internal Communication Systems Limited and these powers were restricted to Lyndhurst, Hampshire.
B. On 6 May 2010, Internal Communication Systems Limited applied to have these powers extended to the counties of Hampshire and Kent;
C. On 18 May 2010, Ofcom published a notification of their proposal to modify the Deemed Direction by way of a further Direction under section 106 in accordance with sections 107 and 115 of the Act so that it applies to Internal Communication Systems Limited and covers the counties of Hampshire and Kent;
D. Ofcom did not receive any representations in relation to the notification and draft Direction;
E. For the reasons set out in the explanatory statement accompanying this Direction, Ofcom are satisfied that in making this Direction they have acted in accordance with their relevant duties set out in sections 3 and 4 of the Act;
NOW, therefore, pursuant to section 106 of the Act, Ofcom make the following Direction-
The Code shall apply to Internal Communication Systems Limited for the purposes of the provision by Internal Communication Systems Limited of an electronic communications network in the counties of Hampshire and Kent.
1. Definitions and Interpretation
2. In this Direction, unless the contrary intention appears-
Act means the Communications Act 2003;
Internal Communication Systems Limited means Internal Communication Systems Limited (registered company number 4281502);
Hampshire means the area administered by Hampshire County Council
Kent means the area administered by Kent County Council
Ofcom means the Office of Communications.
3. Except in so far as the context otherwise requires, words and phrases shall have the same meaning as in the Act, headings and titles shall be disregarded and expressions cognate with those referred to in this Direction shall be construed accordingly.
4. The Interpretation Act 1978 shall apply as if this Direction were an Act of Parliament.
5. This Direction shall take effect on the day it is published.
