Condition 43 of the licences granted to British Telecommunications plc (“BT”) and Kingston Communications (Hull) plc (“Kingston”) under the Telecommunications Act 1984 required those companies to provide telecommunications services other than voice telephony services on request. Services which BT and Kingston were required, by Condition 43, to provide were also subject to Conditions 57 and 58 which, respectively, prohibited undue preference and undue discrimination and required publication of charges, terms and conditions.
