Waiver of BT’s price notification requirements for certain of BT’s PPC and RBS backhaul prices

On 8 August 2005, BT wrote to Ofcom requesting that it consent to BT introducing price changes to certain of its partial private circuits (“PPCs”) products, without it having to comply with the notification requirements imposed on BT under SMP Conditions G6 and GG6 in respect of above-mentioned price changes on this occasion only. BT submitted a similar request in relation to its prices for radio base station (“RBS”) backhaul products on 10 August.

On 8 September 2005, Ofcom published a notification of its proposals to give a consent to BT to enable it to introduce the PPC and RBS backhaul price changes without the need to give advance written notice of its intention to do so. Interested parties were given until 5pm on 22 September 2005 to comment on the matter.

Following consideration of every representation about the proposed consent made in response to the notification, Ofcom has concluded that it is appropriate for it to give consent to BT’s request.
