Wireless Telegraphy Act Licences (Terms, Provisions and Limitations)

The current version of the following reference document is directly cited in The Wireless Telegraphy (Licensing Procedures) Regulations 2006 - SI 2006 No. 2785 made on 16th October 2006. A number of changes will need to be made to the next version to reflect some changes to the legislative framework relating to licensing. These include the Wireless Telegraphy Act 2006 c.36 which came into force on 8 February 2007 and the Wireless Telegraphy (Exemption) (Amendment) Regulations SI 2006 No. 2994 which came into force on 8 December 2006 (Which included exemption of the Citizen's Band Radio Class). These updates are anticipated to be made shortly.
Introduction
This publication details the terms, provisions and limitations which apply to each class of licence listed below, and includes sample licences and, where applicable, the terms and conditions booklets which relate to those licences.

Wireless Telegraphy General Licence Conditions Booklet
IntroductionEach Wireless Telegraphy licence, issued by the Office of Communications ("Ofcom")[ (-1-)] under section 1 of the Wireless Telegraphy Act 1949, authorises the licensee to establish and use stations or install or use apparatus for wireless telegraphy, subject to the terms, provisions and limitations of that licence.
The terms contained in this General Licence Conditions Booklet (the “Booklet”) are incorporated into and form part of the terms, provisions and limitations of each wireless telegraphy licence to which this Booklet applies. (Each such wireless telegraphy licence is referred to as “the Licence”).
General Licence Conditions
Condition 1 - Licence Term, Variation and Revocation1.1 The Licence shall continue in force until revoked by Ofcom or surrendered by the Licensee.
1.2 Pursuant to section 4 of the Wireless Telegraphy Act 1998 (the “1998 Act”) Ofcom may not revoke this Licence under section 1(4) of the Wireless Telegraphy Act 1949 except:
- at the request of, or with the consent of, the Licensee;
- in accordance with Condition 3;
- if there has been a breach of any of the conditions of the Licence;
if, in connection with the transfer or proposed transfer of rights and obligations arising by virtue of the Licence, there has been a breach of any provision of regulations made by Ofcom under the powers conferred by section 168(1) and (3) of the Communications Act 2003[ (-2-)] ; - in accordance with section 4(5) of the 1998 Act;
- if it appears to Ofcom to be necessary or expedient to revoke the Licence for the purposes of complying with a direction by the Secretary of State given to Ofcom under section 5 or section 156 of the Communications Act 2003; or
1.3 Where Ofcom exercise their power to revoke or vary the Licence in accordance with section 1(4) of the Wireless Telegraphy Act 1949, the Licensee shall be notified in writing or by a general notice. Any general notices will be posted on the Ofcom website[ (-3-)].
Condition 2 - Changes2.1 The Licence may not be transferred. [ (-4-)]
2.2 The Licensee must give immediate notice to Ofcom in writing of any change to the Licensee’s name and address from that recorded on the Licence.
Condition 3 - Licence Fee3.1 The Licensee shall pay to Ofcom the relevant sums as provided in section 1(2) of the Wireless Telegraphy Act 1998 and the regulations made thereunder:
- on or before the date of issue of the Licence; and
- on or before the payment date shown on the Licence for subsequent payments or such other date or dates as shall be notified in writing to the Licensee,
in accordance with those regulations and any relevant terms, provisions and limitations of the Licence, failing which Ofcom may revoke the Licence.
Condition 4 - Radio Equipment Use4.1 The Licensee must ensure that the Radio Equipment relevant to each Licence is constructed, established, installed and used only in accordance with the provisions specified in the individual Licence schedules. Any proposal to amend any detail specified in those schedules must be agreed with Ofcom in advance and implemented only after that Licence has been varied or reissued accordingly.
4.2 The Licensee must ensure that the Radio Equipment is used only by persons who have been authorised by the Licensee to do so, and that such persons are made aware of, and of the requirement to comply with, the terms of the Licence.
Condition 5 - Access and Inspection5.1 The Licensee shall permit any person authorised by Ofcom:
- to have access to the Radio Equipment;
- to inspect the Licence and Radio Equipment; and
- at any and all reasonable times or, when in the opinion of that person an urgent situation exists, at any time to ensure that the Radio Equipment is being used in accordance with the terms of the Licence.
6.1 A person authorised by Ofcom may require the Radio Equipment, or any part thereof, to be modified or restricted in use, or temporarily or permanently closed down immediately if in the opinion of the person authorised by Ofcom:
- a breach of the Licence has occurred; and/or
- the use of the Radio Equipment is causing or contributing to Undue Interference to the authorised use of other radio equipment.
6.2 Ofcom may require the Radio Equipment to be modified or restricted in use, or temporarily closed down either immediately or on the expiry of such period as may be specified in the event of a national or local state of emergency being declared. Ofcom may only exercise this power after a written notice is served on the Licensee or a general notice applicable to holders of a named class of Licence is published.
Condition 7 - Interpretation
7.1 In this Booklet and in the Licence:
- the establishment, installation and use of the Radio Equipment shall be interpreted as establishment and use of stations and installation and use of apparatus for wireless telegraphy as specified in section 1 of the Wireless Telegraphy Act 1949;
- the expression "Undue Interference" shall have the meaning given by Section 19 of the Wireless Telegraphy Act 1949; and
- the expression "inspect" includes examine and test.
7.2 In this Booklet “Radio Equipment” means the radio equipment specified in the Licence.
7.3 Any schedule to the Licence shall form part of the Licence together with any subsequent schedule which Ofcom may issue as a variation to the Licence.
7.4 The Interpretation Act 1978 shall apply to the Licence as it applies to an Act of Parliament.

4.- However rights and obligations arising by virtue of certain wireless telegraphy licences may be transferred in accordance with regulations made by Ofcom under powers conferred by section 168(1) and (3) of the Communications Act 2003. The following is a generic description of the CAA recorded radio equipment fitted to the referenced aircraft and as such the type and method of installation are CAA approved and authorised for use in the frequency bands listed under this licence. For registered aircraft it should be ensured that any change to the radio installation is CAA approved with prior notification of any such change being made to the CAA to provide continued validity or re-issue of this licence where appropriate. |

The licence also authorises the use of Aeronautical VHF Hand portable radio equipment operating in the frequency band 118 to 137 MHz and UHF radio equipment operating in the frequency bands 455.475 to 455.850 MHz and 460.775 to 461.225 MHz for use on the above named aircraft. Emergency equipment operating in frequency bands 121.5 MHZ and 406 MHZ are also authorised. |

User of the Station |

The Licensee shall not permit or suffer any person to use the station unless that person:
Article 26 paragraph 4a(i) of the Air Navigation Order exempts glider pilots operating on the nominated glider frequencies and persons being trained as flight crew in UK registered aircraft from the requirement to hold an operators qualification. However, glider pilots must contact air traffic control if they wish to enter controlled airspace for which they must hold the Flight Radiotelephony Operators Licence The Licensee shall ensure that all persons using the station are made aware of and comply with the terms of the licence. |

Radio Equipment Use
The Licensee must ensure that the Radio Equipment is constructed and used only in accordance with the provisions specified in this licence. Any proposal to amend any detail specified in the schedule(s) must be agreed with the Civil Aviation Authority (CAA) or Ofcom in advance and implemented only after this licence has been varied and/or reissued accordingly.
The Licensee must ensure that the Radio Equipment is used only by persons who have been authorised by the Licensee to do so and that such persons are made aware of, and of the requirements to comply with, the terms of this Licence.
Access and InspectionThe Licensee shall permit a representative of the CAA or Ofcom:
- to have access to the Radio Equipment
- to inspect this Licence at any and all reasonable times (or when, in the opinion of Ofcom, an urgent situation exists, at any time) for the purpose of verifying compliance with the terms of this licence.
A person authorised by Ofcom may require the Radio Equipment, or any part thereof, to be modified or restricted in use, or temporarily or permanently closed down immediately if in the opinion of the person authorised by Ofcom:
- a breach of this Licence has occurred; and/or
- the use of the Radio Equipment is causing or contributing to undue interference to the use of other authorised radio equipment.
Ofcom may require the Radio Equipment to be modified or restricted in use, or temporarily or permanently closed down either immediately or on the expiry of such period as may be specified:
- in the interests of long term spectrum planning; or
- in the event of a national or local state of emergency being declared.
Ofcom shall exercise their power by a written notice served on the Licensee and/or by a general notice applicable to this class of Licence.
InterpretationIn this licence:

Notes
The Licensee must ensure that the Radio Equipment is constructed and used only in accordance with the parameters set out below. Any proposal to amend any detail specified in this licences must be agreed with the Civil Aviation Authority (CAA) or Ofcom in advance and implemented only after this licence has been varied and/or reissued accordingly.
The Licensee must ensure that the Radio Equipment is used only by persons who have been authorised by the Licensee to do so and that such persons are made aware of, and of the requirements to comply with, the terms of this Licence.
Power is expressed in:
- Peak Envelope Power (PX or pX) of a radio transmitter: the average power supplied to the antenna transmission line by a transmitter during one radio frequency cycle at the crest of the modulation envelope taken under normal operating conditions.
- Mean Power (PY or pY) of a radio transmitter: the average power supplied to the transmission line by a transmitter during an interval of time sufficiently long compared with the lowest frequency encountered in the modulation taken under normal operating conditions.
- Carrier Power (PZ or pZ) of a radio transmitter: the average power supplied to the antenna transmission line by a transmitter during one radio frequency cycle taken under the condition of no modulation.
- Effective Radiated power (in a given direction) by the addition of the letter “e”: The product of the power supplied to the antenna and its gain relative to a half wave dipole antenna in a given direction.
For use in formulae, the symbol p denotes power expressed in Watts and symbol P denotes power expressed in decibels relative to a reference level. The symbol e denotes effective radiated power (erp)(in a given direction). The product of the power supplied to the antenna and its gain relative to a half-wave dipole in a given direction
The symbols used to designate the classes of emission have the meanings assigned to them by the Radio Regulations. The Radio Regulations means the 1982 edition of the Radio Regulations and its subsequent amendments.
ANO Approval
Prior to making any transmissions with this radio station, an Air Navigation Order Approval must be held for the purpose for which the station is to be used or a formal authority to undergo commission transmission must have been issued. Any transmissions must only be made under the terms set down in the ANO Approval or authority for commissioning testing.

This terms provisions and limitations booklet is applicable for the following licence class:
Citizens' Band Radio
OF 215 December 2005 (Rev 0)These Terms, Provisions and Limitations shall be read as an integral part of the Citizens' Band Radio Licence.
Establishment and use1. The Licensee may:
a. establish any station or stations for Wireless Telegraphy (" a CB Station ") formed only of wireless telegraphy apparatus which either:
i. complies with United Kingdom Interface Requirement IR 2027; or
ii. is certified or type approved prior to 8 April 2001 in accordance with either Department of Trade and Industry Performance Specifications MPT 1320, MPT 1333, or MPT 1382 or European Telecommunications Standard ETS 300 135 and marked on the front panel of the apparatus in accordance with the appropriate specification.
b. use a CB station for sending and receiving only:
i. messages in plain speech;
ii. signals of less than 2.5 seconds in length which are intended to call up any other CB Station;
iii. signals of less than 1 second in length which are intended to identify a CB Station or to mark the end of a message sent by a CB Station.
iv. data signals in accordance with clause 12.
Limitations on use
Apparatus of CB Station
2. The wireless telegraphy apparatus forming a CB Station shall not be used:
Ancillary equipmenta. unless it is operated on the frequencies specified in accordance w1'th sub-clause 1 (a);
b. if at any time, such use:
i. is likely to obstruct the Police, or the Office of Communications (Ofcom) officers or Government body in the carrying out of their duties;
ii. causes harmful interference to any other wireless telegraphy,
c. in the following modes:
i. unattended operation of a CB station;
ii. operation of a CB station in digi-peater mode or node operation;
iii. operation of all mailbox and bulletin board systems;
iv. interconnection with the Public Switch Telephone Network (PSTN)
3 (1) Except as provided at 3 (2) below, only the following ancillary equipment may be connected between the antenna socket of the transceiver of a CB Station and its antenna:
a. devices for suppressing interference;
b. low pass filters;
c. mechanically operated co-axial antenna change over switches.
3 (2) A meter to measure the transmitter output power or Voltage Standing Wave Ratio (VSWR) of the antenna may be temporarily inserted between the antenna socket of the transceiver and the antenna for the sole purpose of establishing or testing a CB Station providing that such meters are removed before a CB Station is used.
4. (1) If a CB station has provision for connection to an external antenna then such apparatus shall only be connected to one of the following types of antennas:
a. a single vertical omnidirectional monopole antenna, the driven element of which does not exceed 6.9Sm in length or SSmm in diameter, including any loading coils and associated circuitry and casings, but excluding any plates, radial wires or rods designed solely to act as a ground plane or counterpoise, which are located at the physical base of the antenna;
b. a single vertical omnidirectional dipole antenna not exceeding S.5Sm in length. The use of a loop, Vagi or any type of beam antenna is prohibited.
4 (2) In all cases, if a CB Station is situated within 1 km of the boundary of any aerodrome, the height of the antenna, any supporting mast or structure must not exceed 15 m.
Operators of station(s)5. (1) A CB station shall only be used by:
a. the Licensee; or
b. any person whom the Licensee has reasonable grounds to believe is not a disqualified person, where such person's use is in the presence of and under the direct supervision of the Licensee.
5 (2) In this clause 5, a "disqualified person" means any person:
a. whose United Kingdom Citizens' Band Radio Licence is currently revoked or varied as a result of revocation action;
b. whose last application for a Citizens' Band Radio Licence was refused by Ofcom as a result of revocation action;
or
6A CB station:c. who, in the last six months, has been convicted of an offence under wireless telegraphy legislation in the UK.
Conditions of the Licencea. shall not be established or used in any aircraft vehicle and shall not be established or used on board ship except with the consent of the Ship's Master;
b. shall not be used for the purpose of advertising goods or services of any kind.
7(1) Subject to the payment of the fee in the manner indicated in sub-clause 7 (2) below, the Licence shall continue in force from year to year unless revoked by Ofcom.
7 (2) The Licensee shall pay to Ofcom before the anniversary of the Date of Issue in each year, the fee on renewal prescribed by the Regulations for the time being in force under sub-section 2(1) of the Act, and on the payment of the fee Ofcom will issue to the Licensee a document in the form of the title page of this Licence (the"Validation Document") which will indicate the next date for renewal.
7 (3) If the Licensee does not pay the fee in the manner described in sub-clause 7(2), then the Licence shall expire at the end of the day before the relevant anniversary date of the Date of Issue.
7 (4) The Licensee shall surrender the Validation Document to Ofcom forthwith upon the revocation of the Licence. Ofcom reserves the right to publish the name of the Licensee if the Licence is revoked.
7 (5) Where Ofcom exercises his power to revoke or vary all Citizens' Band Radio Licences, a general notice issued in accordance with Section 1 (4) of the Act to all holders of such Licences shall be published in the following manner:
(a) by means of an authorized broadcast for the purposes of sub-section 1 (4) of the Act, this Licence may be revoked, or its terms, provisions or limitations varied, by a notice in writing by Ofcom served on the Licensee, or by a general notice addressed to all holders of a Citizens' Band Radio Licence published on the Ofcom website or broadcast nationally by the British Broadcasting Corporation
8 The CB Station and this Licence shall be available for inspection on demand at any reasonable time by any person authorised by Ofcom.
9 A CB Station shall be closed down at any time on the demand of any person authorised by Ofcom.
9 (a) To the extent that they do not conflict with or are not inconsistent with any of the clauses herein, the Notes set out at the rear of these, Terms, Provisions and Limitations shall be complied with by the Licensee.
(b) Ofcom reserves the right to release details of the call sign of the Licensee specified in the Validation Document to third parties in order that the call sign may be published in call books compiled by third parties, either in written form or in the form of "read only" computer disks.
Operations by CEPT Citizens' Band Radio Users in accordance with CEPT Recommendations T/R 20-09
10 The following additional provisions apply to non-resident Citizens' Band Radio users temporarily visiting and operating wireless telegraphy apparatus in the United Kingdom in accordance with CEPT Recommendations T/R 20-09, as enabled by the Wireless Telegraphy Apparatus (Citizens' Band European Users) (Exemption) Regulations 1989.
10 (1) Unless the individual is a disqualified person as defined in sub clause 5(2). CEPT Citizens' Band Radio users may operate in the United Kingdom provided they are:
(a) aged 14 years or over;
(b) ordinarily resident in a country listed in note 8 to the Citizens' Band Radio licence; and
(c) authorised by the government of that country to use a relevant CB Station in its territory.
10(2) Subject to this clause 10, CEPT Citizens' Band Radio users shall comply with these Terms, Provisions and Limitations.
Operations by the Licensee in Accordance with CEPT Recommendations T/R 20-09 11 The Licensee may operate in countries which have implemented CEPT Recommendations T/R 20-09 in accordance with the following terms.
11 (1) The Licensee shall:
(a) be a temporary visitor and non-resident in the host country;
(b) operate only equipment that has been type-approved to either Department of Trade and Industry Performance Specification MPT 1333 or European Telecommunications Standards Institute Performance Specification ETS 300135 and is marked in accordance with the appropriate specification;
(c) comply with the requirements applicable to the use of wireless telegraphy apparatus at the location of operation in the host country;
(d) present this Licence upon request to the relevant supervisory authorities in the host country; and
(e) comply with the relevant provisions of CEPT Recommendations T/R20-09.
12 Operation by the Licensee of data on a CB station is limited to a one-to-one operation, which does not include digi-peater mode and shall be on the following basis:
(a) the channels shall be used in simplex mode only;
(b) the data unit interface with the Wireless Telegraphy apparatus forming a CB station shall be made only though the external microphone input socket and/or receive audio/speaker output socket with the aid of suitable cables/switch;
(c) the data modulating the transmitter shall be the AX25 Amateur Packet Radio Link Layer Protocol;
(d) the class of emission shall be G2D. Only two tones shall modulate the (said) transmitter. The maximum frequency of the highest tone modulating the (said) transmitter shall be 2200 Hz. There shall be not more than 1000 Hz frequency between the two tones. If a connection is not established within 20 seconds, the transmitter keying control line shall be reset;
(e) the Licensee shall transmit their full postcode in Morse telegraphy:
(i) at the beginning and end of each period of communication;
(ii) at the end of each interval of 15 minutes, when the period of communication is longer than 15 minutes;
(iii) at the beginning of transmission on a new frequency (whenever the frequency of transmission is changed); and
(iv) on the same carrier frequency that is being used for communication.
(f) the Licensee shall ensure that the data interface equipment is compatible with the wireless telegraphy apparatus forming part of a CB Station, that any interconnecting cables/switch which are fitted are suitable for operation and that no interference to other electrical, electronic or radio apparatus is caused;
(g) the wireless telegraphy apparatus forming part of a CB Station shall comply with UK Interface Requirement 2027 published when operated in conjunction with the data interface equipment;
(h) apart from the operation of data on a CB Station, and subject to the preceding clauses, Licensees shall comply with the relevant existing licensing terms provisions and limitations.
Interpretation13 In this Licence, except where stated otherwise, words and expressions shall have the same meaning as they have in the Act.
Notes to the CB Licence1 It is the responsibility of the Licensee to ensure that no unauthorised use of a CB Station takes place.
2 The CB Station may be used for business and other commercial activities subject to the limitations in clause 5 of this Licence.
3 Only equipment which conforms in all respects to the appropriate Department of Trade and Industry or European Telecommunications Standards Institute Performance Specification may be used. This Licence does not permit the use of equipment which has been modified in any way. In particular Licensees should note that this Licence does not allow use of equipment which has been modified:
(a) to allow transmission or reception on other or additional frequencies; or
(b) to produce a greater output power. (However, terminals or other connecting points are permitted for the use of a voice synthesizer device to provide an aural indication of the selected channel. The voice synthesizer device shall not modulate the transmitter.)
4 Please note that this Licence does not permit:
(a) Use of the following equipment:
(i) Power Amplifiers (also known as "linear amplifiers", "burners", "boots" or "assistance"),
(ii) Antennas other than as specified in Clause 4 of this Licence, (iii) Devices designed to encrypt or distort speech, or data
(iv) Devices to allow a CB Station to be interconnected with the Public Service Telephone Network,
(v) Devices to allow a CB Station to be remotely controlled,
(vi) Repeater stations.
(b) The following uses of licensed equipment;
(i) The retransmission of any pre-recorded material,
(ii) The retransmission of any broadcast material, (iii) The transmission of music in any form.
5 Only mechanical antenna switches which do not use radio frequency energy in any way may be used.
6 Please note that the installation and use of a CB Station may be subject to local regulations and bye-laws. In particular the installation of antennas must conform to local planning restrictions. You may also need to obtain consent before using equipment covered by this Licence on private or public property.
7 When operating a CB Station, every effort shall be made to avoid causing interference to other electronic or electrical apparatus.

10 Information which infringes the Data Protection Act 1998, copyright, personal or corporate privacy shall not be sent.; and
11 Channels EU24(27.235MHz), EU25(27.245MHz) and EU32 (27.325MHz) within the existing CEPT allocations should be used for transmission of data.
12 Digi-peater mode is mode available within the AX25 Amateur Packet Radio Link Layer Protocol whereby the data unit re-transmits a received packet in the form received and without error correction.
13 A node is a data unit connected to one or more CB radios forming all or part of a CB station able to store and re-transmit for onward routing, complete or parts of a message.
CB Code of practiceRemember to always "Watch the LIPS":
- BE LEGAL - Read your licence carefully and always comply with its terms and conditions.
- DON 'T CAUSE INTERFERENCE - Remember that other radio services may be affected by your transmissions.
- BE PATIENT - Show patience and consideration towards other users.
- BE SAFE - Don't risk your life or anyone else's.
CB Radio is licensed under the Wireless Telegraphy Act 1949. It is the responsibility of the licensed user to ensure that all use of his or her station(s) conforms in every detail with the restrictions contained in the CB Licence Conditions. The few rules governing CB are designed to minimise interference to other radio users.
Please read your Licence carefullyIn particular, users should make sure that they use only approved CB equipment. This includes antennas, accessories and ancillary equipment. It is an offence to use non-approved equipment, including otherwise legal radios that have been modified to increase power output or the number of channels in use.
Licence-holders must ensure that other people using CB under the cover of their licence obey the law at all times. You are responsible for all use under your licence.
Remember that to use grossly offensive, indecent, obscene or threatening language may be a criminal offence.
InterferenceAlthough the legal CB service has been designed specifically to minimise interference to other radio services, all radio transmissions can cause problems to other users. There are several things you can do to minimise this:
- Only use legal CB equipment.
- Don't tamper with your rig. Modifications to change the power output or the number of channels can cause interference.
- Use the low power switch where possible.
- Don't transmit close to radio masts, airfields or the emergency services; their radio could be saving a life.
- Don't site your antenna near to TV reception aerials.
- Using a low-pass filter between your rig and antenna may help to reduce interference.
- Be considerate to other users.
- Respect operating conventions - leave Channel 09 clear for emergencies, Channel 14 for calling and Channel 19 for mobile use. Also respect any local conventions regarding the use of a channel for a specific purpose.
- Always give priority to emergency calls on any channel. Remember the next emergency call may concern you, your family or friends.
- If you hear a call for help and if no one else is providing assistance, give any help you can.
- Remember that CB is not a substitute for the 999 (or marine VHF channel 16) service. There is no official organisation monitoring CB, and there may not always be a local volunteer monitor listening.
- Before you transmit, listen with the "Squelch" control turned fully down (i.e. background noise at a maximum) - don't barge in on existing conversations.
- Keep conversations short - don't hog channels, everyone has an equal right to use them.
- Be patient towards newcomers, everyone has to learn. Help them with interference and other problems if you can.
- Be sympathetic to neighbours suffering interference to their radio or television reception. If they are having problems obtain a copy of the leaflet "Interference to TV and Radio Reception", available free of charge on request from Ofcom.
- Remember CB can be an aid to business as well as an entertaining and useful hobby. Help others to enjoy it as much as you do.
- Never erect or remove an antenna near to or under electricity transmission lines. CB users have been killed doing so. If in doubt ask your local Electricity Board for advice.
- Take care at railway level crossings and other areas when driving a vehicle fitted with a CB antenna. High antennas can touch low wires causing electrocution so don't fit 1/2 and 5/8 wavelength (antennas for 26 - 27 MHz equipment (sub-clause 4(1)) to vehicles or use any type of long antenna for mobile operation.
- Use common sense when transmitting. Don't let your use of CB interfere with your ability to drive. Don't transmit when there is risk of an explosion, such as when you are at a petrol station.
- Don't transmit with the antenna less than 15cm (6 inches) from your face. Remember that concentrated radio energy can be dangerous.

It is the responsibility of the Licensee to ensure that no unauthorised use of a Community Audio Distribution System Station takes place.
Please note that this Licence does not permit the use of the following equipment:
- Power Amplifiers (also known as "linear amplifiers", "burners", "boots" or "assistance");
- Antennas other than as specified in Clause 6 of this Licence;
- Devices designed to encrypt or distort speech;
- Devices to allow a Community Audio Distribution System Station to be interconnected with the Public Service Telephone Network;
- Devices to allow a Community Audio Distribution System Station to be remotely controlled;
- Repeater stations.
Please note that the installation and use of a Community Audio Distribution System Station may be subject to local regulations and bye-laws. In particular the installation of antennas must conform to local planning restrictions. You may also need to obtain consent before using equipment covered by this Licence on private or public property.
In all cases if a Community Audio Distribution System Station is situated within 1 km of the boundary of any aerodrome, the height of the antenna (together with any supporting mast or structure) must not exceed 10 metres.
When operating a Community Audio System Station, every effort shall be made to avoid causing interference to other electronic or electrical apparatus.
The wireless telegraphy apparatus forming a Community Audio Distribution System Station shall not be used:
- unless it is operated on the frequencies specified in Schedule 1, section 3.
- if at any time, such use is likely to obstruct the Police, or the Office of Communications Investigation Service in the carrying out of their duties.
A Community Audio Distribution System station shall only be operated by the Licensee or by a person who has been authorised to operate the station by the Licensee.
A Community Audio Distribution System station shall not be used for the purpose of advertising goods or services of any kind.
6. Ancillary equipment
Only the following ancillary equipment may be connected between the antenna socket of the transmitter of a Community Audio Distribution System Station and its' antenna:
- devices for suppressing interference;
- low pass filters;
- mechanically operated co-axial antenna change over switches;
- a meter to measure the transmitter output power or Voltage Standing Wave Ratio (VSWR) of the antenna may be temporarily inserted between the antenna socket of the transmitter and the antenna for the sole purpose of establishing or testing a Community Audio Distribution System Station providing that such meters are removed before a Community Audio Distribution System Station is used.
If a Community Audio Distribution System station has provision for connection to an external antenna then such apparatus shall only be connected to a single vertical omni directional half wave antenna. The antenna should be no more than 10 metres above the ground level.
The use of loop, yagi or any type of beam antenna is prohibited.

This licence is applicable for the following licence classes:
Restricted Radio Services Transmission (Class A-Freely radiating); Restricted Radio Services Transmission (Class B-Radiating Cable); Restricted Radio Services Transmission (Class C-Freely radiating very low power).

NOTES TO SCHEDULE I
- The symbols used to designate the classes of emission in Box J have the meanings assigned to them in the International Telecommunication Convention and Radio Regulations.
- The maximum power specified in Box K is the effective monopole radiated power (emrp) in respect of medium wave transmissions, and the effective radiated power (erp) in respect of VHF transmissions.
- In the case of VHF transmissions, the polarisation specified in Box L is horizontal (H), vertical (V) or mixed (M).
- Unless otherwise stated in Box N, the level of suppression of radiated unwanted emissions shall be that specified in the Radio Regulations of the International Telecommunication Union (Appendix 8-2).
SCHEDULE II
Special Conditions to the Licence
Purpose of Use
(1) The Licensee named in Box B of Schedule I shall use the station named in Box G of Schedule I for emitting and receiving wireless telegraphy messages by the method of telephony for the purpose of providing a restricted sound broadcasting service in the United Kingdom .
Limitations on Use
(2) The Radio Equipment may only be used:
- On the frequency shown in Box M of Schedule I;
- At a power not exceeding that in Box K of Schedule I;
- With the emission characteristics described in Box J of Schedule I;
- With the polarisation shown in Box L of Schedule I;
- At the location shown in Box H of Schedule I.
Change of Address of Emergency Contact
(3) The Licensee shall give Ofcom prior written notice of any change of name, address, or telephone number of the emergency contact identified in Box D of Schedule I.
Interpretation
(4) In this Licence:
"United Kingdom" means the United Kingdom of Great Britain and Northern Ireland, the Channel Islands and the Isle of Man; and
"restricted sound broadcasting service means a service of the type defined in section 245(4)(c) of the Communications Act 2003"
General Terms and Conditions of the Licence
1 This Licence granted under section 1 of the Wireless Telegraphy Act 1949 ("the Act") by Ofcom authorises the Licensee to establish, install and use radio transmitting and receiving stations and/or radio apparatus as described in Schedule I (hereinafter together called the "Radio Equipment") subject to the terms set out below.
Licence Term
2 This Licence shall continue in force until the date of expiry shown in Schedule I, unless revoked earlier by Ofcom or surrendered by the Licensee.
Licence Variation and Revocation
3 Ofcom may exercise their power to vary or revoke this Licence by a written notice served on the Licensee or by a general notice applicable to holders of this class of Licence.
Changes
4 This Licence may not be transferred.
5 The Licensee must give prior or immediate notice to Ofcom of any change of the name and/or address shown in Schedule I.
Fees
6 The Licensee shall pay Ofcom the fee as shown at the top of page 1 of the Licence in accordance with section 2(1) of the Act and the Regulations made thereunder, before the date of issue of this Licence.
Radio Equipment Use
7 The Licensee must ensure that the Radio Equipment is constructed and used only in accordance with the provisions specified in the schedules. Any proposal to amend any detail specified in the schedule(s) must be agreed with Ofcom in advance and implemented only after this Licence has been varied or reissued accordingly.
8 The Licensee must ensure that the Radio Equipment is only used by persons who have been authorised by the Licensee to do so and that such persons are made aware of, and comply with, the terms of this Licence.
Access and Inspection
9 The Licensee shall permit Ofcom and any other person authorised by Ofcom:-
i) to have access to the Radio Equipment; and
ii) to inspect this Licence and the Radio Equipment at any and all reasonable times or, when in the opinion of that person an urgent situation exists, at any time, to ensure the Radio Equipment is being used in accordance with the terms of this Licence.
Modification, Restriction and Closedown
10 A person authorised by Ofcom may require the Radio Equipment to be modified in operation, restricted or temporarily or permanently closed down immediately if in the opinion of the person authorised by Ofcom:
i) a breach of this Licence has occurred; and/or
ii) the use of the Radio Equipment is causing or contributing to undue interference to the use of other authorised radio equipment.
Powers of Notice
11 Ofcom may serve written notice on the Licensee and require the Radio Equipment to be modified in operation, restricted or temporarily or permanently closed down either immediately or on the expiry of such period as may be specified in the notice:
- in the interests of long term spectrum planning; or
- in the event of a national or local state of emergency being declared.
Interpretation
12 In this Licence:-
- the establishment, installation and use of the Radio Equipment shall be interpreted as establishment and use of stations and installation and use of apparatus for wireless telegraphy as specified in section 1 of the Act;
- the expression "undue interference" shall have the same meaning that it has under the Act;
- the expression "inspect" includes examine and test;
- the schedules form part of this Licence together with any subsequent schedules which Ofcom may issue as a variation to this Licence at a later date;
- the Interpretation Act 1978 shall apply to the Licence as it applies to an Act of Parliament.
NOTES TO THE LICENCE
(1) The Licensee shall surrender the licence to Ofcom or any other person acting on behalf of Ofcom forthwith upon its revocation.
(2) The holding of this Licence does not relieve the Licensee (or any person whose services the Licensee is contracted to transmit) of any requirement to hold any other licences (particularly that required by the Broadcasting Act 1990).
(3) The technical specifications of the transmitter shall be as set out in Ofcom’s "Guidance Notes for Freely Radiating Restricted Services".
This licence is applicable for the following licence classes:
Restricted Radio Services Transmission (Class A-Freely radiating); Restricted Radio Services Transmission (Class B-Radiating Cable); Restricted Radio Services Transmission (Class C-Freely radiating very low power).

1. General Terms and Conditions of the Licence
This Licence is granted under section 1 of the Wireless Telegraphy Act 1949 ("the Act") by the Office of Communications (“Ofcom”) and authorises the Licensee to establish, install and use radio transmitting stations and/or radio apparatus described in the Schedule (hereinafter together called the "Radio Equipment") subject to the terms set out below and in the Schedule.
This Licence is issued to the Licensee for transmission sound broadcasting services described in the Broadcasting Act Licence.
2. Licence Term
This Licence shall enter into force on the Commencement Date and, subject to earlier revocation by Ofcom in accordance with condition 3 below, shall continue in force only until the Termination Date.
3. Licence Variation & Revocation
Pursuant to section 4 of the Wireless Telegraphy Act 1998 (the “1998 Act”) Ofcom may not revoke this Licence before the termination date above under section 1(4) of the Wireless Telegraphy Act 1949 except:
- at the request of, or with the consent of, the Licensee;
- in accordance with Condition 5;
- if there has been a breach of any of the conditions of this Licence;
- in accordance with section 4(5) of the 1998 Act;
- if it appears to Ofcom to be necessary or expedient to revoke this Licence for the purposes of complying with a direction by the Secretary of State given to Ofcom under section 5 or section 156 of the Communications Act 2003;
- for reasons related to the management of the radio spectrum, provided that in such case the power to revoke may only be exercised after one (1) year’s notice is given in writing to the Licensee; or
- if the Broadcasting Act Licence ceases to remain in force.
Where Ofcom exercise their power to revoke or vary the Licence in accordance with section 1(4) of the Wireless Telegraphy Act 1949, the Licensee shall be notified in writing or by a general notice. Any general notices will be posted on the Ofcom website[ (-3-)]; or
Changes
This Licence may not be transferred.

The Licensee shall pay to Ofcom the relevant sums as provided in section 1(2) of the Wireless Telegraphy Act 1998 and the regulations made thereunder:

- on or before the payment date indicated in the table on the first page of this Licence for subsequent payments or such other date or dates as shall be notified in writing to the Licensee,
in accordance with those regulations and any relevant terms, provisions and limitations of the Licence, failing which Ofcom may revoke this Licence.

The Licensee must ensure that the Radio Equipment is constructed, established, installed and used only in accordance with the provisions specified in Schedule. The schedule to this Licence shall form part of this Licence together with any subsequent schedule which Ofcom may issue as a variation.

1. The Radio Equipment
The transmitting radio apparatus which is authorised by this Licence is the radio station at the site described in Box G at the location indicated in Box H, of the table below (the “Radio Equipment”).
2. Purpose of Use
The Licensee shall use the station Radio Equipment for emitting wireless telegraphy messages for the purpose of providing the sound broadcasting service described in the Broadcasting Act Licence.
3. Technical Requirements
The Licensee shall comply with the following technical requirements:
- The Radio Equipment may only be used for wireless telegraphy on the frequency shown in Box M of the table below.
- The radiating elements of the aerial used in connection with the Radio Equipment shall be at the height specified in Box I of the table below.
- The class of emissions shall be as specified in Box J of the table below. [This is the symbol used to designate the permitted class of emission, having the meaning assigned to it in the International Telecommunication Convention and Radio Regulations.]
- The maximum permitted radiated power in the azimuthal direction of greatest strength shall not exceed that specified in Box K of the table below. More detailed limits and directional constraints may be contained in Annex 4 of the Broadcasting Act Licence.
- For VHF transmissions the polarisation shall be within that specified in Box L. More detailed limits for the radiated power in each plane of polarisation may be contained in Annex 4 of the Broadcasting Act Licence.
- All VHF transmissions are required to meet minimum suppression levels in the aeronautical bands, as specified in the Radio Regulations of the International Telecommunication Union (Appendix 8-2). Further to this, the Licensee shall ensure that the output of the licensed transmitter complies with any additional suppression levels set out in Box N, at the aeronautical frequencies specified there. Also shown in Box N are any other broadcast frequencies at the site that may contribute towards the subject interference mechanism and also require to meet the additional suppression requirements. The Licensee must liaise with the operators of those frequencies at the start of transmissions, or following any modifications to their equipment that might affect the radiated output on the aeronautical frequency(s) concerned.
Licensees are also expected to comply in full with their Broadcasting Act Licence, which contains at Annex 4, specific parameters for each transmitting site. That licence also requires compliance with the Ofcom Local Analogue Licence Engineering Code, which contains general rules on site engineering, to be applied in the installation, testing and measurement of radio broadcast transmission system
NOTES TO SCHEDULE
(G) Is the recognised site name from which the assignment is to be radiated. There may be more than one site name describing the same location, also one site name may describe more than one mast.
(H) Is the permitted location, given in both Geographical and Ordnance Survey coordinates containing the mast from which the assignment is to be radiated.
(I) Is the permitted height of the radiating elements of the antenna above local ground level and ignores the height of any buildings upon which masts may be mounted.
(K) Radiated power is specified here as the effective monopole radiated power (emrp) in respect of MF transmissions, and the effective radiated power (erp), as the sum of the maxima permitted in each plane of polarisation, in respect of VHF transmissions.

The Licensee must liaise with the operators of those frequencies at the start of transmissions, or following any modifications to their equipment that might affect the radiated output on the aeronautical frequency(s) concerned.
Licensees are also expected to comply in full with their Broadcasting Act Licence, which contains at Annex 4, specific parameters for each transmitting site. That licence also requires compliance with the Ofcom Local Analogue Licence Engineering Code, which contains general rules on site engineering, to be applied in the installation, testing and measurement of radio broadcast transmission system

(G) Is the recognised site name from which the assignment is to be radiated. There may be more than one site name describing the same location, also one site name may describe more than one mast.
(H) Is the permitted location, given in both Geographical and Ordnance Survey coordinates containing the mast from which the assignment is to be radiated.
(I) Is the permitted height of the radiating elements of the antenna above local ground level and ignores the height of any buildings upon which masts may be mounted.

DESCRIPTION OF RADIO EQUIPMENT COVERED BY THIS LICENCE
This schedule forms part of Licence «LICENCE», issued to «customer_name», the Licensee on «date», and describes the Radio Equipment covered by the Licence and the purpose for which the Radio Equipment may be used.
1. Description of the Radio Equipment licensed
In this Licence, the Radio Equipment means sending and receiving station(s) (“base stations”) and sending and receiving station(s) (“mobile stations”) for wireless telegraphy as defined in paragraph 2 below.
2. Purpose of the Radio Equipment
Subject to the administrative and technical requirements set out in this and the subsequent schedule(s) to this Licence, the Licensee and any person authorised to act on the Licensee’s behalf is hereby authorised to:
- send and receive messages concerning the business of the Licensee between the base station(s) and the mobile station(s); and/or
- send and receive messages concerning the business of the Licensee between the mobile stations.
3. Conformity Assessment Requirements
The Radio Equipment covered by this Licence shall be subject to and comply with the appropriate Interface Requirement (IR) or for equipment first placed on the market before 8 April 2000, is required to be type approved in accordance with the appropriate published technical performance standards authorised at the date of installation of the Radio Equipment, subject to any modifications authorised by Ofcom.
4. Special conditions relating to the activities of the Licensee
- The Licensee shall ensure that the Radio Equipment is:
- used for voice transmission only, unless authorised in paragraph 5 below or in the subsequent schedule(s);
- not used to transmit music, broadcast programmes or obscene or offensive language;
- not used as a public address system; and
- not used to send misleading messages.
- Upon receipt of messages not connected with the business of the Licensee, the Licensee or any person using the Radio Equipment shall not:
- make known the contents of any such message, its origin or destination, its existence or the fact of its receipt to any person, except to a duly authorised officer of the Her Majesty’s Government, a person authorised by the Ofcom or in the course of legal proceedings or for the purpose of any report thereof; and
- retain any copy or make any use of any such message, or allow it to be reproduced in writing, copied or made use of.
5. Facilities
The use of the following facilities is permitted without specific authorisation, provided that no undue interference is caused to other authorised radio users:
- revertive calling;
- user identification;
- overlay paging, provided that the number of overlay pagers does not exceed the number of mobile stations in the service subject to this Licence;
- quasi-synchronous operation of base stations;
- remote receivers;
- selective calling; and
- the following methods of voice privacy:
- frequency inversion;
- band inversion;
- band scrambling; and
- rolling code inversion.
- the use of DTMF for PSTN and/or PABX interconnection is authorised.
6. Special conditions relating to UK General services
- UK General stations can be used anywhere within the area(s) specified in the subsequent schedule(s), provided the Agency Local Licensing Centre responsible for the location of the stations, is informed of the stations location and period of use, before they are brought into operation.
- UK General stations shall not be used at the same location for a period exceeding one year. Where UK General stations are to be used at the same location for a period exceeding one year, the Licensee shall apply for an appropriate PBR licence before the end of the one year period.
- UK General base stations shall not be installed or used unless prior authority has been obtained from the Agency Local Licensing Centre responsible for the location of the intended base stations.
7. Base stations
The Licensee shall ensure that:
- base stations do not communicate directly with other base stations; and
- base stations located at shared sites shall not be used in single frequency mode.
8. Call signs
a) The Licensee shall ensure that the call sign:
- is announced at the beginning of all transmissions; and
- is transmitted in the same format that is being used for the transmission of the information.
b) The call sign(s) shall be as specified in the subsequent schedule(s).
9. Interpretation
In this and the subsequent schedule(s):
- a “ UK General service” is a radio system which can be used anywhere within the United Kingdom or within a particular area of the United Kingdom ;
- “revertive calling” means the automatic acknowledgement of messages received by mobile stations by means of predefined status messages;
- “user identification” identifies the user sending a message;
- “overlay paging” allows a user who temporarily leaves their mobile station to be alerted to the fact that a message has been sent to the mobile station;
- “quasi-synchronous operation of base stations” is where more than one base station transmits the same message on the same channel in different areas;
- “remote receiver” is a mobile station that receives messages on licensed frequencies only;
- “selective calling” is a sequence of in-band audio tones normally transmitted immediately prior to the commencement of a voice transmission or transmitted on their own to convey information;
- “shared site” is a site with more than one base station where the base stations do not share common facilities such as an antenna and/or coupling facilities;
- “single frequency mode” means the use of a single frequency for both transmitting and receiving messages;
- “ERP” means effective radiated power, which is the power radiated from the antenna in the direction of maximum radiation; and
- “IR” means the United Kingdom Radio Interface Requirement published by Ofcom in accordance with Article 4.1 of directive 1999/5/EC of the European Parliament and of the Council on radio equipment and telecommunications terminal equipment (RTTE) and mutual recognition of their conformity. The Directive (O.J.No.L91) was implemented in the UK by the Radio Equipment and Telecommunications Terminal Equipment Regulations (S.I. 2000/730).

SCHEDULE 1 TO LICENCE NUMBER «LICENCE»
DESCRIPTION OF RADIO EQUIPMENT COVERED BY THIS LICENCE
This schedule forms part of Licence «LICENCE», issued to «customer_name», the Licensee on «date», and describes the Radio Equipment covered by the Licence and the purpose for which the Radio Equipment may be used.
1. Description of the Radio Equipment licensed
In this schedule the Radio Equipment means:
- base transceiver stations (“base stations”) and mobile transceiver stations (“mobile stations”) for use in a Private Mobile Radio (“PMR”) speech and/or data service; and
- base transmitter stations (“base stations”) and mobile receiver stations (“mobile stations”) for use in a Radio Paging and/or Short Range Business Paging (“SRBP”) service as defined in paragraph 2 below.
2. Purpose of the Radio Equipment
Subject to the technical and administrative requirements set out in this and any subsequent schedule(s) to this Licence, the Licensee and any person authorised to act on their behalf is hereby authorised to:
- install and make test transmissions during the service and repair of Private Business Radio (“ PBR ”) and marine equipment (“service and repair”);
- hire to a person (“the customer”) for use in connection with the business of the customer (“hiring”):
(i) PMR equipment for a period not exceeding one year; and/or
(ii)trunked PMR equipment for a period not exceeding one year, and/or
(iii) Radio Paging equipment for a period not exceeding one year;
- allocate to a customer for use in connection with the business of the customer, pending an application by that customer for an operational licence granted under the Wireless Telegraphy Acts 1949 and 1998 (“parking”):
(i) PMR equipment for a period not exceeding 3 months; and/or
(ii)trunked PMR equipment for a period not exceeding 3 months; and/or
(iii)SRBP equipment for a period not exceeding 3 months;
- demonstrate to a customer for use in connection with the business of the customer (“demonstration”):
(i) PMR equipment for a period not exceeding 28 days; and/or
(ii) trunked PMR equipment for a period not exceeding 28 days; and/or
(iii) SRBP equipment for a period not exceeding 28 days.
3.Business location(s)
The Licensee shall carry out the activities specified in paragraph 2 above at/or from:
- the permanent location(s) specified in paragraph 2 of schedule 2; and/or
- temporary location(s) notified in writing to the Ofcom National or Regional Licensing Centre specified in paragraph 1 of schedule 2 prior to establishment.
4. Special conditions relating to the activities of the Licensee
The Licensee shall ensure that:
- all reasonable steps are taken to ensure that the use of Radio Equipment by a customer complies with the conditions of this Licence;
- the Radio Equipment:
- is operated in accordance with the frequencies, powers, characteristics, classes and antenna heights specified in the schedule(s) except with prior written authority from the Ofcom;
- does not interconnect to any telecommunications network except where hiring trunked PMR Radio Equipment and/or parking and/or demonstrating trunked PMR Radio Equipment;
- is not operated as a cross band repeater;
- is not used to transmit music, broadcast programmes or obscene or offensive language; and
- is not used as a public address system;
- any use of tones for CTCSS is only as set out in Groups A and B of MPT 1306;
- any use of codes for DCS is only as set out in MPT 1381;
- all frequency information and licence numbers shall be removed before disposal of any item of Radio Equipment; and
- the type approval and/or Radio & Telecommunications Terminal Equipment (“R& TTE ”) conformity of the Radio Equipment is not invalidated.
5.Service and repair
While undertaking service and repair the licensee shall ensure that:
- the Radio Equipment is connected to either a suitable radio frequency dummy load, a radio frequency test apparatus containing a dummy load or an appropriate radiating antenna;
- the transmitting frequency of the Radio Equipment is monitored prior to any transmission, which may only take place if the frequency is not in use during the monitoring period; and
- any transmission shall be of the minimum possible duration to complete the necessary service and repair.
- any transmission on maritime international channels shall be made by a holder, or under the personal supervision of a holder of the appropriate maritime radio operators certificate; and
- where transmissions take place on board marine vessels, such vessels shall be moored or out of the water and not in transit.
6. Hiring PMR and/or Radio Paging equipment
While undertaking hiring the licensee shall ensure that:
- there exists a written contract between the Licensee and the customer;
- PMR equipment shall only be used for voice communication, except by means of selective calling;
- Radio Paging equipment shall only be used for one-way tone and/or text message paging from base station(s) to mobile station(s) within the customer’s premises or within the perimeter of a site which is completely under the customer’s control;
- prior authority is obtained from the Ofcom National or Regional Licensing Centre responsible for the business location or the Local Licensing Centre requested by the Licensee for the use of talkthrough and/or reverse frequency working, either of which must be controlled by either CTCSS and/or DCS , except where used on-site; and
- dual frequency channels shall be controlled by either CTCSS and/or DCS.
7. Hiring trunked PMR Radio Equipment
While undertaking the hiring of trunked PMR Radio equipment, the licensee shall ensure that:
- there exists a written contract between the licensee and the customer
- trunked PMR Short Term Hire equipment can be used for voice and data communication
8. PMR parking and/or demonstration
While undertaking PMR parking and/or demonstration the licensee shall ensure that:
- prior authority is obtained from the Ofcom National or Regional Licensing Centre responsible for the business location or the Licensing Centre requested by the Licensee, for the transmission of data, except where used on-site, for the purpose of user identification, for the purpose of vehicle status identification or by means of selective calling; and
- prior authority is obtained from the Ofcom National or Regional Licensing Centre responsible for the business location or the Ofcom Licensing Centre requested by the Licensee, for the use of talkthrough and/or reverse frequency working, either of which must be controlled by either CTCSS and/or DCS , except where used on-site.
9. SRBP parking and/or demonstration
While undertaking SRBP parking and/or demonstration the licensee shall ensure that:
- the customer is instructed to apply for an SRBP licence within 7 days of the commencement of the parking period; and
- the Radio Equipment shall only be used for one-way tone and/or text message paging from base station(s) to mobile station(s).
10. Call signs
The Licensee shall ensure that during PMR transmissions the call sign:
- is announced at the beginning of all transmissions; and
- is transmitted in the same format that is being used for the transmission of the information;
and unless otherwise agreed by the Ofcom National or Regional Licensing Centre responsible for the business location or the Ofcom Licensing Centre requested by the Licensee, the call sign for hiring and demonstrating PMR equipment shall be as specified in schedule 2, and for parking PMR equipment as specified in the customer’s PBR licence application form.
11. Notification requirements
- For hiring, parking and/or demonstrating PMR and/or Radio Paging equipment at Large Events, the Licensee shall seek special arrangements in advance from the Ofcom National or Regional Licensing Centre responsible for the location of the Large Event to enable the co-ordination of frequencies and call signs.
- For hiring trunked PMR radio equipment and/or parking and/or demonstrating trunked PMR radio equipment for use at Large Events, the licensee shall notify the Ofcom National or Regional Licensing Centre responsible for the location of the Large Event.
- For parking PMR equipment and/or parking trunked PMR equipment, the Licensee shall submit a copy of the customer’s PBR licence application form before the Radio Equipment is brought into operation. The customer may submit the application form separately. The application form must be fully completed and, where the applicant does not already have an appropriate PBR licence, the licence fee paid.
12. Extensions to hiring, parking and/or demonstration periods
The Licensee shall ensure that in the exceptional circumstances that the customer requires an extension of use beyond the time periods specified in paragraph 2 above and in schedule 2, prior authority is obtained from the Ofcom National or Regional Licensing Centre responsible for the business location or the Ofcom Licensing Centre requested by the Licensee.
13. Customer information
The Licensee shall:
- inform customers of the following matters in writing before use of the Radio Equipment commences:
- the terms of the licence that governs the use of the Radio Equipment supplied;
- that failure to meet the terms of this Licence may result in the closedown of the Radio Equipment;
- the penalties for improper use of the Radio Equipment; and
- the procedures for service and repair of the Radio Equipment by the Licensee;
- inform hire customers in writing before use of the Radio Equipment commences that where the Radio Equipment is used beyond the time limits specified in paragraph 2 above and in schedule 2, they must apply to Ofcom for an appropriate PBR licence, except as provided for in paragraph 11 above;
- give to hire customers before use of the Radio Equipment commences a copy of the hire contract, which must be kept with the Radio Equipment.
14. Recording hire contracts
The Licensee shall record the following information for each hire contract and ensure that the information is available for inspection at all reasonable times by persons authorised by Ofcom:
- the hire contract with the customer;
- site details of each installation or use of radio;
- customer contact name, address and phone number;
- details of Radio Equipment on hire; and
- frequencies, CTCSS tones and/or DCS codes in use.
15. Pre-delivery inspection procedures for hire equipment
The Licensee shall design pre-delivery inspection procedures for Radio Equipment to be hired in accordance with good engineering practice to ensure that:
- the Radio Equipment provided for hire is in a mechanically and electrically sound condition;
- all accessories and ancillary items detailed in the hire contract are supplied; and
- where practicably possible Radio Equipment shall be suitably labelled with licence numbers and stock numbers, taking care not to obscure original labels or markings.
16. Hiring on
The Licensee may hire stations from other PBR Suppliers licensees and in turn hire the stations to customers.
17. Conformity Assessment Requirements
The Radio Equipment covered by this Licence shall be subject to and comply with the appropriate Interface Requirement (IR) or the Merchant Shipping (Marine Equipment Regulations 1999). Equipment first placed on the market before 8 April 2000 , is required to be type approved in accordance with the appropriate published technical performance standards authorised at the date of installation of the Radio Equipment, subject to any modifications authorised by Ofcom, as specified below:
- for service and repair:
i) all PBR and marine Interface Requirements and technical performance standards;
- for hiring PMR equipment:
- MPT 1302, MPT1304 and MPT 1326;
- ETS 300 086, ETS 300 296, ETS 300 341 and ETS 300 219;
- IR 2001 and IR 2002;
There are also provisions for hiring Radio Equipment approved to:
MPT 1303 - New licences ceased to be issued after 30 September 2000 . Thereafter, existing licences may be renewed on the basis that the Radio Equipment must not cause undue interference and the service will be unprotected from interference unless CTCSS and/or DCS is fitted. Use after 30 September 2005 will only be on an unprotected, non interference basis;
- for hiring Radio Paging equipment:
- MPT 1335 and MPT 1365;
- ETS 300 224;
- IR 2003;
- for parking and/or demonstrating PMR equipment:
- IR 2001 and IR 2002;
- for parking and/or demonstrating SRBP equipment:
i) IR 2003;
- for hiring trunked PMR Radio equipment and/or parking and/or demonstrating trunked PMR Radio equipment:
- MPT 1327 or at least as efficient;
- IR 2001 and IR 2002
18. Interpretation
In this schedule:
- “Private Business Radio” means Private Mobile Radio, Radio Paging and Short Range Business Paging;
- “business location” means the location:
- at which the Licensee services and/or repairs PBR equipment and/or hires PMR and/or Radio Paging equipment;
- at or from which the Licensee parks and/or demonstrates PMR and/or SRBP equipment;
- “CTCSS” means Continuous Tone Controlled Signalling System and Continuously Tone Controlled Sub-Audio Squelch;
- “ DCS ” means Digitally Coded Squelch;
- “on-site” means a limited operating area normally up to 3 kilometres in radius from a specified location;
- “wide area” means an operating area greater than 3 km and typically up to 30 km in radius from a specified location;
- a “cross-band repeater” is a network of stations operating so that a message received on a frequency in one radio spectrum band is re-broadcast on a frequency in another radio spectrum band;
- a “dummy load” means a radio frequency non-radiating termination;
- “user identification” identifies the user sending a message;
- “vehicle status identification” is an abbreviated report transmitted to the controller on factors concerning the vehicle’s business use;
- “selective calling” is a sequence of in-band audio tones normally transmitted immediately prior to the commencement of a voice transmission or transmitted on their own to convey information;
- “talkthrough” means communication between one mobile station and another mobile station with the message repeated by the base station to establish the communication. For this purpose both mobiles must be capable of movement and may not be used as fixed control stations;
- “reverse frequency working” is a system in which the base station can relay the transmission from another station and is controlled other than by landline;
- “Large Event” means an event where there is extensive use of radio at the same location. Large Events are listed in the PBR Suppliers licence information sheet 347 and on the Ofcom web site. Ofcom will inform Licensees of other Large Events as they occur;
- “ERP” means effective radiated power, which is the power radiated from the antenna in the direction of maximum radiation; and
- “IR” means the United Kingdom Radio Interface Requirement published by Ofcom in accordance with Article 4.1 of directive 1999/5/EC of the European Parliament and of the Council on radio equipment and telecommunications terminal equipment (RTTE) and mutual recognition of their conformity. 2. Radio Equipment Use
- The Licensee must ensure that the Radio Equipment us constructed and used only in accordance with the provisions specified in the schedule(s). Any proposal to amend any detail specified in the schedule(s) must be agreed with Ofcom in advance and implemented only after the Licence has been varied and/or re-issued accordingly.
- The Licensee must ensure that the Radio Equipment is only used by persons who have been authorised by the Licensee to do so and that such persons are made aware of, and of the requirement to comply with, the terms of this Licence.
3. Restrictions
Notwithstanding any other conditions expressed or implied elsewhere, Point to Point Fixed Links operating on frequencies between 1450 MHz and 1530 MHz designated as 1.5 GHz or 1500 MHz sub-bands, operators of which having been given notice to cease operating them by 31 March 2007, will, from 30 September 2006, instead be subject to a six-month 'notice to cease operations' period.
(This restriction does not apply to links operating on frequencies between 1350 MHz and 1375 MHz paired with frequencies in the range 1492 MHz to 1517 MHz, designated the 1.4 GHz or 1400 MHz band).
4. Conformity Assessment Requirements
The Radio Equipment covered by this Licence shall be subject to and comply with the appropriate Interface Requirement (IR) as specified below:
- In accordance with Articles 4.1 and 7.2 of Directive 1999/5/EC, UK Radio Interface Requirement 2000 (UK RIR 2000) specifies the requirements for the licensing and appropriate use of fixed terrestrial (point to point) radio systems.
- It is a condition of this licence that the installed equipment meets the minimum requirements specified in this UK RIR2000 for the stated equipment types and for the stated frequency bands.
Equipment first placed on the market before 8 April 2000 , is required to be type approved in accordance with the appropriate published technical performance standards authorised at the date of installation of the Radio Equipment, subject to any modifications authorised by Ofcom.

6. Site clearance requirements

7. Interpretation
In this schedule:
- "ETSI" means the European Telecommunications Standards Institute;
- "ETS" means European Telecommunications Standard;
- "EIRP" means the effective radiated power of a radio transmitter of the power supplied to the antenna and the antenna gain relative to an isotropic antenna:
- "ITU" means the International Telecommunications Union, and "Emission designation" shall have the meaning as defined in the ITU Radio Regulations RR 4-2 and Appendix 6 Parts A & B.

This schedule forms part of Licence issued to the Licensee on (date), and describes the Radio Equipment covered by the Licence and the purpose for which the Radio Equipment may be used by the Licensee.
The companies authorised by this Licence to operate the radio equipment described in this schedule are:
1. Description of the Radio Equipment licensed
Fixed Scanner Station(s) and outstation(s) for sending and receiving wireless telegraphy at the sites, frequencies and technical parameters specified in schedules to be issued by THE LICENSEE to the individual operators specified above, and subsequently attached to the licence.
2. Apparatus
- In accordance with Articles 4.1 and 7.2 of Directive 1999/5/EC, UK Radio Interface Requirement 2037 (UK RIR 2037) specifies the requirements for the licensing and appropriate use of such radio systems.
- It is a condition of this licence that the installed equipment meets the minimum requirements specified in this UK RIR2037 for the stated equipment types.
3. Frequency Assignment Criteria and Channel Allocation Arrangements
The assignment criteria used by THE LICENSEE will be in accordance with the version of Technical Frequency Assignment Criteria (Ofcom document OF 49W) in force at the time the assignment is made, covering services operating in the frequency band 457.5 to 485.5 MHz paired with 463.0 to 464.0 MHz. As explained in that document the Adaptable Channel Plan set out for the 24 channels reserved for the water industry will be followed when such assignments are made.
In addition, THE LICENSEE may make assignments for the water industry companies listed above, where there is an operational need which cannot be met from the allocated 24 channels, in the spectrum reserved for non-utility operators (channels T73 to T80).
In the specific case of the Channel Islands (Jersey Public Services Department) a substitute set of channels has been identified, agreed with Ofcom, and declared to the French administration.
4. Annual Licence Renewal Fees
The annual renewal fee will be calculated on the basis of the channel fee set out in the current Ofcom Fees Regulations, and payment(s) will be co-ordinated by the licensee on behalf of the whole membership. To reflect water industry use of channels T73 to T80 an additional channel fee will be included in this settlement..
5. Radio interference and/or channel sharing disputes
In the event of radio interference and/or channel sharing disputes, the operator should contact the licensee, unless an urgent situation exists, in which case the appropriate Ofcom National/Regional Centre should be approached.
6. Maintenance of Frequency Assignment Records
During the period this licence remains in force and for 6 months thereafter, the Licensee shall complete and maintain accurate written records of:
- Comprehensive details of the technical parameters and location of each scanner and outstation, and the operator involved, in the format which has been agreed with Ofcom; and the licensee /operator must produce the above records when a person authorised by Ofcom requires him to do so.
- THE LICENSEE shall inform Ofcom of the address of the premises at which the information at sub-paragraph (a) above shall be kept.
- THE LICENSEE must submit to Ofcom copies of the records detailed above at such intervals as Ofcom shall notify.
7. Interpretation
In this schedule “ THE LICENSEE” means the organisation which manages on behalf of Ofcom the block of UHF scanning telemetry spectrum allocated to water industry.

1. Description of the Radio Equipment licensed
In this Licence, the Radio Equipment means registered Fixed Wireless Access sending and receiving station(s) (“terminals”) for wireless telegraphy.
2. Purpose of the Radio Equipment
Subject to the administrative and technical requirements set out in this and the subsequent schedule(s) to this Licence, the Licensee and any person authorised by the licensee to use the terminals under authority of this Licence are hereby authorised to send and receive transmissions between terminals for Fixed Wireless Access purposes.
3. Conformity Assessment Requirements
The Radio Equipment covered by this Licence shall be subject to and comply with Interface Requirement IR2007 - Fixed Broadband Services operating in the frequency range 5725 -5850 MHz
4. Special conditions relating to the activities of the Licensee
The Licensee shall ensure that:
- the Radio Equipment is only used for the purpose of Fixed Wireless Access; and
- the location of each terminal forming part of the Radio Equipment is registered with Ofcom in accordance with Ofcom’s registration procedures prior to installation and use.
5. Terminals
The Licensee shall ensure that terminals:
- are fixed and only used at the registered location; and
- are only installed or used in accordance with the conditions defined in Schedule 2 of this licence
6. Interpretation
In this and the subsequent schedule(s):
- “Fixed Wireless Access” is a system used to connect two or more fixed points for the purpose of sending or receiving data. The system can include a point to point network, a point to multi-point network, a MESH network or any other network configuration;
- “IR” means the United Kingdom Radio Interface Requirement published by Ofcom in accordance with Article 4.1 of Directive 1999/5/EC of the European Parliament and of the Council on radio equipment and telecommunications terminal equipment (RTTE) and mutual recognition of their conformity. The Directive was implemented in the UK by the Radio Equipment and Telecommunications Terminal Equipment Regulations (S.I. 2000/730).

- establish sending and receiving stations for wireless telegraphy on land at the location specified in Schedule 2 to this Licence (“the Base Stations”);
- establish the sending and receiving stations for wireless telegraphy on board vessels specified in Schedule 2 of this licence (“the Mobile Stations”);
- use the Base Stations and Mobile Stations for the purpose of sending and receiving voice and data messages concerning the business of the Licensee between the Base Stations and the Mobile Stations and between the Mobile Stations.
3. Approved Standards for the Radio Equipment
The Radio Equipment covered by this Licence shall be subject to and comply with the appropriate Interface Requirement (IR) or the Merchant Shipping (Marine Equipment Regulations 1999). Equipment first placed on the market before 8 April 2000 , is required to be type approved in accordance with the appropriate published technical performance standards authorised at the date of installation of the Radio Equipment, subject to any modifications authorised by Ofcom, as specified below:
- MPT 1250; or
- Radio Equipment specified to MPT1251 or MPT1252 or ETS300162 or ETS300225 may also be considered by Ofcom for use as Base Station equipment as long as all channels, other than the channel(s) shown on subsequent schedules to this licence, can be made inoperable or
- Radio Equipment specified to MPT1251 or MPT1252 or ETS300162 or ETS300225 may be used as Mobile Station apparatus.
4. Special conditions relating to the activities of the Licensee
The Licensee shall ensure that:
- the Radio Equipment is used only in accordance with the frequencies, powers, characteristics, antenna details and any other requirements specified in Schedule 2 to this Licence except with prior written authority from Ofcom;
- Mobile Stations operate only on frequencies set out in Schedule 2. A Ship Radio Licence issued by Ofcom is required for use of any other frequencies, including International Channel 80;
- land-to-land communication is prohibited unless otherwise specified in Schedule 2 or in an emergency where there is a risk to life;
- continuous transmissions are prohibited unless otherwise specified in Schedule 2 to this Licence;
- the connection of any of the Stations with the Public Telephone Network (PSTN) or with other Private Branch Exchanges (PBX) is prohibited unless otherwise specified in Schedule 2;
- in an emergency involving risk to life or navigation, the Licensee may use the Base Stations or Mobile Stations for the purpose of sending and receiving messages between the Base Stations and any other station for wireless telegraphy;

- establish sending and receiving stations for wireless telegraphy on land at the location specified in Schedule 2 to this Licence (“the Base Stations”);
- use the Base Stations for the purpose of sending and receiving voice and data messages relating to the training of radio operators.
3. Equipment Use
- All radio equipment must be used only within and be rendered incapable of transmission outside of the building of the Licensee Address.
- The station subject to the Licence shall only have a maximum permitted field strength limited to 0 dBµv/m at 10 metres distance.
- The station subject to the Licence shall cause no interference during the conduct of training to any other licensed radio services, domestic broadcast reception apparatus, telephone, computer, domestic entertainment equipment or otherwise. If interference is caused, remedial action must be taken by the Licensee to the satisfaction of the Ofcom.

1. Description of the Radio Equipment licensed
In this Licence, the Licensee is authorised to use the base transceiver or transmitter and/or mobile transceiver or receiver stations for use in accordance with paragraph 2 below (the “Radio Equipment”).
2. Purpose of the Radio Equipment
Subject to the administrative and technical requirements set out in this and Schedule 2 to this Licence, the Licensee and any person authorised to act on their behalf is hereby authorised to:
- establish sending and receiving stations for wireless telegraphy on land at the location specified in Schedule 2 to this Licence (“the Base Stations”);
- establish the sending and receiving stations for wireless telegraphy on board vessels specified in Schedule 2 of this licence (“the Mobile Stations”);
- use the Base Stations and Mobile Stations for the purpose aiding the navigation and/or location of any Ship Station and only to send, receive or re-transmit a message or signal by automatic or non-automatic means in order to indicate to the Ship Station its position, velocity, or any other relating to this activity, including obstruction warning.
3. Approved Standards for the Radio Equipment
The Radio Equipment covered by this Licence shall be subject to and comply with the appropriate Interface Requirement (IR) or the Merchant Shipping (Marine Equipment Regulations 1999). Equipment first placed on the market before 8 April 2000 , is required to be type approved in accordance with the appropriate published technical performance standards (MPT 1200 series) authorised at the date of installation of the Radio Equipment, subject to any modifications authorised by Ofcom.
4. Special conditions relating to the activities of the Licensee
The Licensee shall ensure that:
- the Radio Equipment is used only in accordance with the frequencies, powers, characteristics, antenna details and any other requirements specified in Schedule 2 to this Licence except with prior written authority from Ofcom;
- use of the Radio Equipment complies with the relevant provisions of the Radio Regulations;
- Mobile Stations operate only on frequencies set out in Schedule 2. A Ship Radio Licence issued by Ofcom is required for use of any other frequencies, including International Channel 80;
- land-to-land communication is prohibited unless otherwise specified in Schedule 2 or in an emergency where there is a risk to life;
- continuous transmissions are prohibited unless otherwise specified in Schedule 2 to this Licence;
- the connection of any of the Stations with the Public Telephone Network (PSTN) or with other Private Branch Exchanges (PBX) is prohibited unless otherwise specified in Schedule 2;
- in an emergency involving risk to life or navigation, the Licensee may use the Base Stations or Mobile Stations for the purpose of sending and receiving messages between the Base Stations and any other station for wireless telegraphy;
- the Licensee must ensure that the Base Stations or Mobile Stations are only used by persons who have been authorised by the Licensee to do so and who have been made aware of, and comply with, the terms of this Licence. In the event of an emergency where there is a risk to life, the Base Stations and Mobile Stations may be used by any person;
- the Base Stations and Mobile Stations shall be called and identified by their authorised call signs.
5. Site Clearance Requirements
A valid site clearance certificate, issued by Ofcom is required for Base Stations when the antenna height exceeds 30 metres above ground level.
6. Technical Performance Requirements
The Licensee must ensure that:
- if it is to be connected with the PSTN, the Radio Equipment , is approved under section 84 of the Telecommunications Act 1984.
7. Interpretation
In this and subsequent schedule(s):
- “ERP” means effective radiated power, which is the product of the power supplied to the antenna and its gain relative to a half-wave dipole in a given direction. The power supplied to the antenna is expressed in the form of peak envelope power. The peak envelope power is defined as the average power supplied to the antenna transmission line by a transmitter during one radio frequency cycle at the crest of the modulation envelope taken under normal operating conditions;
- the “antenna gain” is the ratio, usually expressed in decibels, of the power required at the input of a loss-free reference antenna top the power supplied to the input of the given antenna to produce, in a given direction, the same field strength or the same power flux density at the same distance. The antenna gain is expressed in decibels relative to a half-wave dipole (dBd) and refers to the direction of maximum radiation;
- words and expressions in this licence have the same meaning as they have in the Wireless Telegraphy Act 1949;

1. Description of the Radio Equipment Licensed
In this Licence, the Licensee is authorised to use coastal station radio equipment, ship radio equipment and navigational aids for use in the Maritime Radio service in accordance with paragraph 2 below (the “Radio Equipment”).
2. Purpose of the Radio Equipment
Subject to the administrative and technical requirements set out in this and Schedule 2 to this Licence, the Licensee and any person authorised to act on their behalf is hereby authorised to:
- install, demonstrate and make test transmissions during the service and repair of maritime radio equipment;
- install and demonstrate maritime radio equipment during the course of the licensee’s retail business.
3. Approved Standards for the Radio Equipment
The Radio Equipment covered by this Licence shall be subject to and comply with the appropriate Interface Requirement (IR) or the Merchant Shipping (Marine Equipment Regulations 1999). Equipment first placed on the market before 8 April 2000 , is required to be type approved in accordance with the appropriate published technical performance standards authorised at the date of installation of the Radio Equipment, subject to any modifications authorised by Ofcom, as specified below:
- MPT 1250; or
- Radio Equipment specified to MPT1251 or MPT1252 or ETS300162 or ETS300225 may also be considered Ofcom for use as Base Station equipment as long as all channels, other than the channel(s) shown on subsequent schedules to this licence, can be made inoperable; or
- Radio Equipment specified to MPT1251 or MPT1252 or ETS300162 or ETS300225 may be used as Mobile Station apparatus;
- Merchant Shipping Notice MSN 1735 (M+F) published by the Maritime and Coastguard Agency.
4. Special Conditions Relating to the Activities of the Licensee
The Licensee shall ensure that:
- the Radio Equipment is used only in accordance with the frequencies, powers, characteristics, antenna details and any other requirements specified in (b) below or in Schedule 2 to this Licence except with prior written authority from Ofcom;
- the Radio Equipment shall be used only on ship frequencies and in accordance with the maximum powers and classes of emission, within the maritime allocations only, of the frequency bands as designated in the Radio Regulations;
- the Radio Equipment is only used at the location specified in Schedule 2 to this Licence or at temporary locations notified in writing Ofcom Operations – Licensing at Riverside House, 2a Southwark Bridge Road, London SE1 9HA;
- land-to-land communication is prohibited unless otherwise specified in Schedule 2 or in an emergency where there is a risk to life;
- continuous transmissions are prohibited unless otherwise specified in Schedule 2 to this Licence;
- the connection of any of the Stations with the Public Telephone Network (PSTN) or with other Private Branch Exchanges (PBX) is prohibited unless otherwise specified in Schedule 2;
- the Radio Equipment shall be called and identified by their authorised call signs. The call sign must be announced at the beginning of all transmissions and transmitted in the same format for the remainder of the transmission.
- their customers are aware of the requirement for and the terms of the licence that governs the use of the Radio Equipment and the penalties for improper use thereof.
5. Test Conditions Relating to Distress and Safety Frequencies
The licensee shall ensure that whilst carrying out tests on the specific distress and safety frequencies that the following conditions apply.
- All transmissions relating to this licence should be carried out in accordance with agreed international maritime procedures.
- The licensee shall notify Ofcom in writing at the address specified below before any transmission take place:

The following specific conditions relating to specific frequencies should be followed: - 121.5/243MHz- Aeronautical Distress frequencies.
- Inappropriate transmissions on these frequencies could affect Search and Rescue (SAR) operations. All tests relating to inspections or demonstrations, where possible, should be carried out under suppressed conditions.
- Radiating tests on 121.5MHz and 243MHz can only be authorised by prior, specific, written agreement with the listed authorities stating the requested time, duration and location of the test.
- Transmissions of non-operational test signals on the emergency frequencies 121.5MHz and 243MHz must be coordinated with the competent listed authorities and carried out only during the first five minutes of each hour, with each test transmission lasting no longer than 10 seconds. This is in accordance with the provisions of §17B of Appendix 13 to the International Telecommunication Union Radio Regulations in order to avoid unjustified alerts in automatic emergency systems
- The duration of the test should be kept to a minimum and the licensee should inform the listed authorities both before and upon completion of the test.
- 123.1MHz
- Inappropriate transmissions on this frequency could interfere with SAR incidents in progress.
- Tests on this frequency can only be carried out with prior agreement with the listed authorities.
- 406- 406.1 MHz
- Due to the instantaneous response of SAR authorities, distress beacons operating on frequencies within the 406-406.1MHz band, coded with operational protocols, may not be operated under radiating conditions.
- Distress beacons operating within the 406-406.1MHz band and coded with the Test User Protocol may be tested after having coordinated the test with, and received approval from the listed authorities.
- 1.6GHz
- Radiated tests on this frequency can initiate a search and rescue response.
- Tests on this frequency can only be carried out with the prior agreement of the listed authorities.
6. Service, Repair and Installation
While undertaking service and repair of Maritime radio equipment, the licensee shall ensure that:
- the Radio Equipment is connected to either a suitable radio frequency, non-radiating termination (dummy load), or radio frequency test apparatus containing a dummy load or an appropriate radiating antenna; and
- the frequency on which the Radio Equipment is intended to be operated must be monitored prior to any transmission, which may only take place if the frequency is not in use; and
- all transmissions shall be of the minimum possible duration to facilitate the necessary service and repair; and
- all transmissions on international maritime channels shall be made by a holder of, or under the direct supervision of a holder of, the appropriate Maritime Radio Operators’ Certificate of Competence and a valid Authority to Operate issued by Ofcom; and
- only the MMSI number assigned to the vessel under a Ship radio licence is used.
7. Maritime Radio Demonstration
While undertaking demonstration of the Radio Equipment, the licensee shall ensure that:
- prior authority is obtained from Ofcom; and
- any MMSI number used for demonstration purposes must have been authorised in writing by Ofcom; and
- the frequency on which the Radio Equipment is intended to be operated must be monitored prior to any transmission, which may only take place if the frequency is not in use; and
- all transmissions shall be of the minimum possible duration to facilitate the necessary demonstration; and
- all transmissions on international Maritime channels shall be made by a holder of, or under the direct supervision of a holder of the appropriate Maritime Radio Operators’ Certificate and Authority to Operate issued by Ofcom.

This Licence granted on "DATE" authorises the holder named to establish, install and use one VHF or DSC Portable Radio subject to the terms set out in the Licence Terms Booklet.
This Portable Radio Licence covers the use of one hand held portable VHF or VHF/DSC radio transceiver with an internal antenna and power supply that you intend to use on more than one vessel (regardless of those vessels' Licence status). It also covers the use of Personal Locator Beacons or Emergency Position Indicating Beacons as specified in the licence Terms Booklet.
It is issued with a T number as opposed to a vessel call sign and it is usual to use the vessel name as an identifier because of this.
As with any marine radio you are required to either hold personally or be supervised by someone that holds the relevant marine radio operator's certificate.
This Licence and your operator's certificate must be kept with or near the radio at all times when operating it as Ofcom carries out random checks on vessels from time to time. If you are operating a marine radio without the relevant qualification(s) you will be in contravention of the terms and conditions of the Licence and may be prosecuted.

PROGRAMME MAKING AND SPECIAL EVENTS STANDARD LICENCE
SCHEDULE 1 TO LICENCE NUMBER «LICENCE»
DESCRIPTION OF RADIO EQUIPMENT COVERED BY THIS LICENCE
This schedule forms part of Licence «LICENCE», issued to «customer_name», the Licensee on «date», and describes the Radio Equipment covered by the Licence and the purpose for which the Radio Equipment may be used.
1. (a) The Radio Equipment may only be used:
(1) on such frequencies ("the Licensed Frequency"), shown in column 2 of Schedule 2 to the Licence in relation to the particular Radio Equipment in Column 1 of Schedule 2;
(2) at a bandwidth not exceeding that specified in column 3 of Schedule 2 in relation to the Licensed Frequency;
(3) at a power not exceeding that specified in column 4 of Schedule 2 in relation to the Licensed Frequency;
(4) with the emission characteristics described in column 5 of Schedule 2 in relation to the Licensed Frequency;
(5) in accordance with the restrictions contained in column 6 of Schedule 2 in relation to the Licensed Frequency, and where airborne operation is permitted, at a height above ground level not greater than specified in that column;
(6) with the signalling (if any) described in column 7 of Schedule 2 in relation to the Licensed Frequency;
(7) with the polarisation described where appropriate in column 8 of Schedule 2 in relation to the Licensed Frequency;
(8) in conjunction with the duplex frequency (if any) shown in column 9 of Schedule 2 in relation to the Licensed Frequency;
(9) at the location(s) or within the area(s) shown and in accordance with the restrictions contained in column 10 of Schedule 2 in relation to the Licensed Frequency;
(10) during the period of use shown in column 11 of Schedule 2.
(b) The Radio Equipment may not be used to transmit from any aircraft (for the avoidance of doubt, this includes any helicopter, model aircraft or helicopter, or any other airborne object, whether powered or not and whether captive or not), except where specified in column 5 of Schedule 2 in relation to the Licensed Frequency, and such power, subject to such restrictions noted.
2. Technical Performance Requirements
The Radio Equipment shall at all times be installed, maintained and used in such a way that its use does not cause any undue interference with any authorised wireless telegraphy.
3. Purpose of Use
The Licensee shall use the Radio Equipment only:
(a) for Programme Making; or
(b) to enable those directly engaged in Programme Making to communicate with each other; or
(c) to transmit the material produced in Programme Making to a receiving station of the Licensee; or to any receiving station owned and operated by a public telecommunications operator; or to a holder of a Programme Making and Special Events Licence issued under section 1 of the Wireless Telegraphy Act 1949; or to any other person approved by Ofcom; or
(d) to enable those providing safety of life services for exclusive use of participants at public events (including medical, first aid and security but, not including Police, Fire and Ambulance services) to communicate with each other; or
(e) to enable participants engaged in support of a public event to:
(i) communicate with each other.
(ii) command, control and monitor vehicle systems or similar apparatus essential to their primary activity at the event.
(f) to send or receive verbal or non-verbal test messages in connection with sub-clauses (a), (b), (c), (d) or (e) above.
4. Special conditions relating to the activities of the Licensee
(a) The licensee shall ensure that the Radio Equipment is:
(i) Not used to transmit music or other transmissions for general reception or to facilitate unauthorised broadcast; and
(ii) Not used to send a message, communication or other matter in whatever form that is grossly offensive or of an indecent, obscene or menacing character; and
(iii) Not used to send misleading messages.
(b) Upon receipt of messages not connected with the business of the Licensee, the Licensee or any person using the Radio Equipment shall not:
(i) make known the contents of any such message, its origins or destination, its existence or the fact of its receipt to any person, except to a person authorised by Ofcom or in the course of legal proceedings or for the purpose of any report thereof; and
(ii) retain a copy or make use of any such message, or allow it to be reproduced in writing, copied or made use of.
5. Call Sign
Use of the Radio Equipment must whenever practicable be preceded and terminated by the following call sign:

6. Facilities
The use of the following facilities are permitted without specific authorisation, provided that no undue interference is cause to other authorised radio users:
(a) revertive calling;
(b) user identification;
(c) remote receivers;
(d) selective calling;
(e) the following methods of voice privacy:

- band inversion;
- band scrambling and
- rolling code inversion
7. Conformity Assessment Requirements
The Radio Equipment covered by this licence shall be subject to and comply with the appropriate Interface Requirement (IR) or for equipment placed on the market before 8 April 2000, is required to be type approved in accordance with the appropriate published technical performance standards authorised at the date of installation of the Radio Equipment, subject to any modifications authorised by the Ofcom.
8. Interpretation
(a) "Programme Making" includes the making of a programme for broadcast, the making of a film, presentation, advertisement or audio or video tape, and the staging or performance of an entertainment, sporting or other public event;
(b) An “event” is defined as an occurrence of limited duration, typically between one day and a few weeks. Public events include music, religious, other festivals, air, agricultural, country shows and other such events.
(c) “revertive calling” means the automatic acknowledgement of messages received by mobile stations by means of predefined status messages;
(d) “user identification” identifies the user sending a message;
(e) “remote receiver” is a mobile station that receives messages on licensed frequencies only;
(f) “selective calling” is a sequence of in-band audio tones normally transmitted immediately prior to the commencement of a voice transmission or transmitted on their own to convey information;
(g) “IR” means the United Kingdom Radio Interface Requirement published by Ofcom in accordance with Article 4.1 of directive 1999/5/EC of the European Parliament and of the Council on the radio equipment and telecommunications terminal equipment (RTTE) and mutual recognition of their conformity. The Directive (O.J.No.L91) was implemented in the UK by the Radio Equipment and Telecommunications Terminal Equipment Regulations (S.I. 2000/730).

SATELLITE AIRCRAFT EARTH STATION/S ( AES ) NETWORK OPERATOR LICENCE
SCHEDULE 1 TO LICENCE NUMBER [XXXX]
TERMS, PROVISIONS AND LIMITATIONS COVERED BY THIS LICENCE
This Schedule forms part of Licence [xxxx], issued to [xxxx], the Licensee on [xx/xx/xx], and describes the terms and equipment specifications covered by this Licence.
1. The Licensee may establish and use:
Sending and receiving Earth Station(s) ("the Station(s)") on board the aircraft specified in the attached Schedule 4 for the purpose of providing wireless telegraphy links between the Station(s) and Geostationary Satellite(s).
2. Special conditions relating to the Radio Equipment
- Transmissions from the Radio Equipment shall only be made when the Radio Equipment’s operation is enabled by the aircraft’s crew, under the direct control of the Network Control Facility. The Radio Equipment shall provide the aircraft’s crew with a means to immediately terminate transmissions.
- The Radio Equipment shall be operated on a ‘Non-Interference Non-Protected’ basis, that is, the Radio Equipment shall not cause harmful interference to, and shall not claim protection from, other stations operating in accordance with the Radio Regulations.
- The Radio Equipment shall not be permitted to operate when the aircraft is below 7000 feet altitude, or operate during take-off, initial climb-out, final approach, landing or taxiing, except as explicitly permitted under Schedule 3.
- Where an aircraft specified in Schedule 4 is ‘G’ registered, i.e. those registered in the United Kingdom , Channel Islands or the Isle of Man , the Licensee shall ensure that the Radio Equipment on board that aircraft is endorsed by either a separate licence or exemption under section 1 of the Wireless Telegraphy Act 1949.
- The Licensee shall take all reasonably practicable measures to ensure that the contact information set out in Schedule 2 remains up to date at all times.
3. “Essential Requirements”
The Radio Equipment shall comply with the appropriate essential requirements identified in Article 3 of the R& TTE Directive and with the other relevant provisions of that Directive.
4. Frequencies of operation
The Radio Equipment shall be operated within the following frequency ranges:
- in respect of transmission, 14.0 to 14.25 GHz; and
- in respect of reception, 10.70 to 11.70 GHz and 12.50 to 12.75 GHz.
5. Maximum Power
- The maximum power shall not exceed 20 dBW/40 kHz EIRP from any individual Station. Each aircraft may transmit a maximum 50 dBW EIRP each under this Licence.
- Where the Radio Equipment is operating within areas defined in Schedule 3, transmissions shall automatically be terminated on loss or significant degradation of the downlink signal from the relevant Geostationary Satellite.
6. Elevation angle
Where the Radio Equipment is operating on the ground within the United Kingdom , the minimum elevation angle used by any antenna as part of the Radio Equipment shall exceed 7 degrees.
7. Antenna characteristics
The Radio Equipment shall employ antenna(s) with characteristics as declared in Schedule 2.
8. Interpretation
In this and subsequent schedule(s):
(a) “Earth Station” means a station located either on the Earth’s surface or within the major portion of the Earth’s atmosphere and intended for communication:
(i) with one or more space stations; or
(ii) with one or more stations of the same kind by means of one or more reflecting satellites or other objects in space;
(b) “Geostationary Satellite” means a satellite having the earth as its primary body and which remains approximately in a fixed position relative to the earth;
(c) “Network Control Facility” means a central monitoring and management facility for the Stations which is controlled by the Licensee, the location and contact details in respect of which are set out in Schedule 2;
(d) “Radio Regulations” means the 2004 edition of the Radio Regulations made under Article 13 of the Constitution of the International Telecommunication Union;
(e) “R& TTE Directive” means Directive 1999/5/EC of the European Parliament and of the Council on 9 March 1999 on radio equipment and telecommunications terminal equipment and the mutual recognition of their conformity;
(f) all technical terms, unless the contrary intention appears, shall have the meaning assigned to them in the Radio Regulations.
Notes
1. This Licence does not affect the requirement, when necessary, to obtain other licenses or authorisations under the Wireless Telegraphy Act 1949 or other legislation or from other countries prior to the installation or operation of the Radio Equipment. Some administrations may require an amended Aircraft Station Licence. The Licensee is encouraged to seek its own independent professional advice in this respect.
2. This Licence covers the airborne service link, comprising the space to aircraft and aircraft to space radio link.
3. The draft ECC Decision on the free circulation and use of Aircraft Earth Stations ( AES ) in the frequency bands 14.0 – 14.5 GHz, 10.7-11.7GHz and 12.5-12.75 GHz ( ECC /DEC/(05)NN) has been used as reference for the implementation of this licence.
4. For the purposes of complying with Condition 3 of Schedule 1 above (“Essential Requirements”), the following standard is considered a harmonised standard for the purposes of Article 5 of the R& TTE Directive:
(a) EN 302 186.
5. ITU-R Recommendation M.1643 provides the technical and operational requirements for AES of aeronautical mobile-satellite service (AMSS) for the protection of the fixed service (FS), fixed satellite service ( FSS ) and radio astronomy service ( RAS ), with additional national requirements as defined in Schedule 1.
6. Licensees and applicants are advised that they must comply with Civil Aviation Authority ( CAA ) airworthiness requirements and regulations.
7. In the event that information included in the Licence requires variation or updating e.g. where an additional aircraft is sought to be included in Schedule 5 or contact details for the Licensee or the Network Control Facility change, such variations are to be applied for by informing Space Services Unit, Ofcom, detailing the desired amendments. Ofcom will consider any such application and, where appropriate, re-issue a revised Licence.

- the antenna type specified in the Antenna Type column of the schedule;
- a power density not exceeding that specified in the Spectral Power Density Column of the schedule;
- the Station(s) shall be operated only from those locations specified on the schedule.
3. Apparatus
The Licensee shall ensure that:
- The apparatus comprised in the Station(s) (" the Apparatus ") is so designed, constructed, maintained and operated, that its use does not cause any undue interference to other users of the spectrum.
- The apparatus complies with (and is maintained in accordance with) the relevant performance specification(s) published by the operator(s) of the Geostationary Satellite(s).
- The apparatus used for transmission complies with the R& TTE Directive and all appropriate National Interface Requirements for Satellite Earth Stations in force within the UK.
4. National and international obligations
- The earth station must obtain satisfactory site clearance for operation at that location; operators intending to transmit in the Fixed Satellite service frequency bands must obtain national clearance and co-ordination prior to commencing operation in the UK.
- The relevant satellite data shall have been submitted to ITU in accordance with established ITU procedures.
- All transmissions in the Fixed Satellite Service must be terminated prior to any change of location; unless operating under a specific exemption authorised by Ofcom.
5. Requirements specific to Satellite Network Licences
- The minimum elevation angle used by the interactive terminals that operate as part of a satellite network shall exceed 5 degrees.
- Terminals that are included as part of a Network Licence shall implement independent local control and monitoring functions at the terminal, and be authorised, supervised and administered by a Network Control and Monitoring centre.
- The Licensee shall have the facility to disable individual terminal transmission.
- For satellite networks in MESH configuration, the network operator must nominate and notify Ofcom of those earth station(s) located in the UK which have independent centralised control and monitoring functionality and possess the capability to suppress transmissions from any earth station within the network. Earth stations that are capable of dynamic assignment as point-to-multipoint and point-to-point configuration may only be licensed as permanent earth stations.
6. Interpretation
In this and subsequent schedule(s):
- “Earth Station” means a radio transmitter located on the surface of the earth and intended for communication with one or more satellites.
- “Geostationary Satellite” means a satellite in geostationary orbit which remains approximately in a fixed position relative to a position on the surface of the earth.
Notes
- This Licence does not affect the requirement, when necessary, to obtain licences or authorisations under other Acts. All systems covered by this Licence must be licensed under Section 7 of the Telecommunications Act 1984, some satellite television or radio broadcasting services require licences under the Broadcasting Act 1990, and some installations require Local Authority Planning Approval.

REGISTRATION OF SMALL INTERACTIVE TERMINALS USING THE SATCLEAR ON- LINE SYSTEM
The enclosed network earth station licence number «LIC_NO» sets out the general terms and conditions which will apply to all terminals in your network. Your attention is drawn to the comments in the schedule to the licence concerning the SatClear on-line registration system. All terminals which are eligible for rapid clearance must be cleared and registered via this system.
The SatClear database will record the details of all authorised terminals and the list of terminals shown in SatClear will be incorporated into the licence schedule. Ofcom will not issue paper records listing approved terminals for inclusion with the licence documentation.
The data on SatClear will be used to calculate the annual licence charge. As terminal registrations and deletions will be carried out online it is the licensee who is directly responsible for the accuracy of the system data.
SatClear can be accessed via the Ofcom website www.ofcom.org.uk. You will need to appoint a system administrator. This system administrator will be responsible for nominating users, who in turn will be responsible for using the SatClear system to clear and register terminals. - the Apparatus complies with (and is maintained in accordance with) the relevant performance specification(s) published by the operator(s) of the Geostationary Satellite(s);
- earth station antennae shall not be employed for transmission at elevation of less than 3 degrees measured from the horizontal plane to the direction of maximum radiation as specified in ITU Radio Regulation ITU – RR ART . 21.14;
- the component of effective isotropic radiated power directed towards the horizon and the minimum elevation angle above the horizontal must comply with ITU Radio Regulations and not exceed those limits specified by Radio Regulations ITU-RR ART . 21.8 – ART . 21.15;
- in the band 13.75GHz – 14GHz, the e.i.r.p. of any emission from an earth station in the fixed satellite service shall be at least 68 dBW, and should not exceed 85dBW, with a minimum antenna diameter of 4.5m;

- a power not exceeding that specified in the Equivalent Isotropically Radiated Power column of the schedule;
- the antenna type specified in the Antenna Type column of the schedule;
- a power density not exceeding that specified in the Spectral Power Density Column of the schedule;
- The Station(s) shall be operated only from those locations specified on the schedule.
3. Apparatus
The Licensee shall ensure that:
- The apparatus comprised in the Station(s) (" the Apparatus ") is so designed, constructed, maintained and operated, that its use does not cause any undue interference to other users of the spectrum.
- The Apparatus complies with (and is maintained in accordance with) the relevant performance specification(s) published by the operator(s) of the Geostationary Satellite(s).
- Earth station antennae shall not be employed for transmission at elevation angles of less than 3 degrees measured from the horizontal plane to the direction of maximum radiation as outlined in ITU Radio Regulation ITU – RR ART . 21.14.
- The component of effective isotropic radiated power directed towards the horizon and the minimum elevation angle above the horizontal must comply with ITU Radio Regulations and not exceed those limits specified by Radio Regulations RR ART . 21.8 – RR ART .21.15.
- The apparatus used for transmission complies with the R& TTE Directive and all appropriate National Interface Requirements for Satellite Earth Stations in force within the UK.

DESCRIPTION OF RADIO EQUIPMENT COVERED BY THIS LICENCE
1. Licence Term
- The Licence shall continue in force for the period stated in the schedule (to a maximum of six months) unless revoked earlier by Ofcom;
- This Licence is not renewable.
2. Special Conditions Relating To The Activities Of The Licensee
The Licensee shall:
- use measurement equipment to verify from time to time that the Apparatus is operating at the frequency and within the frequency tolerance, with the class of emission and at or below the maximum power specified in Schedule 2;
- not transmit until it has been confirmed as far as reasonably possible that the proposed frequency is not in use at the time of the proposed transmission; and
- not transmit for longer than the minimum necessary for the purpose of the particular trial or operation being performed;
- use the Licensed Stations at the maximum power necessary for a particular trial or operation being performed and only used the maximum power permitted, not exceeding that specified in Schedule A, when necessary.
3. Interpretation
In the Licence, unless the context otherwise requires:
- “Non-Operational” means non-commercial or revenue raising;
- "Temporary" means short term (6 months or less);
- “Trial” means experimental or pilot;
- “New or innovative” means not currently in general use;
- "System" means network;
- "Concept" means ways of using radio.
Notes
The Licence does not protect the Licensee from interference caused by other authorised users of wireless telegraphy.

DESCRIPTION OF RADIO EQUIPMENT COVERED BY THIS LICENCE
This schedule forms part of Licence number xx, issued to xx the Licensee on xx, and describes the Radio Equipment covered by the Licence and the purpose for which the Radio Equipment may be used.
Description of the Radio Equipment licensed
The Radio Equipment covered by this Licence shall be subject to and comply with the following terms, provisions and limitations:
The Radio Equipment must:
operate in the frequency band between150 to 4000 MHz;
not cause or contribute to any undue interference to any wireless telegraphy;
transmit at a total radiated power which does not exceed 0.25mW, the radiated power per spectral line does not exceed 100nW and the radiation measured outside the antenna shield does not exceed 10nW;
be attached with a label warning that use could be stopped on request by person authorised by Ofcom
The licensee or any person using the Radio Equipment must only operate the Radio equipment while in contact with or in close proximity to the ground and their emissions are being directed into the ground;
operate in accordance with a Code of Practice recognised by Ofcom ;
keep a log of use of the Radio equipment which is required upon licence renewal;
notify Ofcom prior to use in the vicinity of Radio Astronomy sites in accordance with the procedures described in Requirement and Guidance Note on Application of Ground Probing Radar Licence 1
Notice of Variations or Revocation
Where Ofcom exercises its power to revoke or vary this Licence in accordance with section 1(4) of the Act, a written notice will be send to the Licensee.
Inspection
The Licensee shall permit a person authorised by Ofcom:

When, in the opinion of Ofcom, or of a person authorised by Ofcom on their behalf:
the Licensee shall restrict the operation of, or closedown and cease to operate, the Station or any apparatus to which the breach relates, immediately in accordance with the demand of a person authorised by Ofcom either permanently or for a specified temporary period in accordance with the demand of a person authorised by Ofcom.
